SERVICES: Miami County Probate Court is a division of the Court of Common Pleas and has exclusive jurisdiction over certain types of cases including estates, guardianships (adults and minors), name changes (adults and minors), adoptions, birth corrections, delayed birth registrations and involuntary commitments for mental illness. 

The probate court issues marriage licenses. The Court also maintains birth and death records from 1867-1908 and other records for genealogy research.

ELIGIBILITY:

Marriage License Requirements- Parties must be 18 years of age without consent from parents. Applicants must appear together at the Probate Court. If one of the applicants is a resident of Miami County they may apply for the license in Miami County, but may get married anywhere in the State of Ohio. If neither is a Miami County resident but they reside in the state of Ohio, they must apply in the county where at least one applicant resides and the marriage may occur anywhere in the state. Out-of-state residents planning a wedding in Miami County must apply for a license in Miami County.

DOCUMENTS NEEDED:

Marriage License: Please make an appointment to obtain your marriage license through our public email probatefile@miamicountyohio.gov. Each party must present valid identification to document age. If either applicant has been previously married and divorced, a file-stamped copy of the final order granting the divorce or dissolution is required for all previous divorces/dissolutions.  All other case types require the filing of approved court documents.

RESTRICTIONS: 

Marriage license: If either applicant is under 18, check with the court

for further requirements.

HOW TO USE: Any time during office hours.

FEE POLICY:  Marriage License fee – $50 (Cash Only). Checks and credit cards are not accepted.

All other fees are set by ORC and Court Rule. Additional $5.00 if you would like two (2) certified copies of your marriage License to be mailed to you after marriage.
